Florida Family Serves City With Lawsuit Over Food Truck

A husband and wife duo say that the pandemic crushed their career plans but they quickly adapted and spent the summer creating a new business for their family, a food truck business known as SOL Burger food truck.

However, they say that an ordinance is prohibiting them and others from serving customers inside city limits, yet oddly enough the city is allowing other food trucks to be able to operate.

It's a situation they think is unconstitutional and they're fighting back against it.

“Tarpon Springs government is not allowed to use their power to pick winners and losers in the marketplace. That choice belongs to consumers,” -- Adam Griffin, attorney with IJ.

The ordinance in place allegedly prohibits food trucks from operating in 90% of the city but other food trucks are allowed to serve in this region who are associated and operated by brick and mortar restaurants.

In their fight against the city they note that it has been admitted that the purpose of the rule was to protect other restaurants from competition but if this is the case this is something that possibly violates the constitution.

A petition has been started to allow food trucks to operate in the region and has gathered more than 1,200 signatures so far.

Businesses don't have a right to use the government to carve out a monopoly for themselves. And when they pass legislation like this insisting that it is to "protect from unfair competition" what they are saying is they don't want people in that community to have a choice.

If a new restaurant opens up next door the only way for it to do better than one which is already there is for customers to choose willingly to go there and support it over the other.

The market is who should decide winners and losers, not the government in determining how many might be able to serve and to try to meet those hunger needs of the community.

Eventually, because of their fight for justice we might see the courts reverse this seeming atmosphere of favoritism and give more individuals around Florida the freedom to earn an honest living by serving their community if they want to.
