Lawsuits are civilized war without physical ammunitions and is always inevitable in businesses. It puts one side on the pitch against the other making one the accused and the other the defendant with the both party willing to put in resources and willing to win. For a regular person, lawsuits can be very expensive, exhausting, frustrating, demanding, time consuming and in some cases not always the best way to resolve an issue but in business, it is inevitable. As a business person, you or your company is either suing someone over a business deal, forcefully/fraudulently acquiring private property, or someone is suing you and your company. I will not be dealing with business to business lawsuit, rather I will be dealing with business/management to employees, business/management to applicants and/or business/management to consumers.

Employment lawsuits

As a business person, you or your business gets a lawsuit from an employee or an applicant to contend either a hire/fire or refusal to hire an employee on a basis of discrimination or unlawful action. Usually, it is some sort of employment contract or promise of continued employment or discrimination bases that serves as a just cause for employees to sue the employer. Firing without a repercussion means doing the things right. Things like having all employees sign a document acknowledging their at-will status which means they could be fired anytime, if they break the terms of agreement. You can’t fire a staff on the basis of retaliation for the exercise of statutory right, you can’t fire an employee on racial, gender, religion, ethnic background, or disability. Membership in the armed forces cannot be fired for serving their nation. As an employer, having a handbook that explains the entire terms and how the system works to the employee as well as disciplinary actions to be taken. Also use writings or query as it is known to document short comings and offence from the employee.

Consumer Protection Laws

Telling lies to your customers or over rating a product which eventually got damaged after a few days of purchase can lead to lawsuit from consumers and Federal Trade Commissions which investigates false advertising claim. Also, phony price comparisons could lead to a law suit by consumers.

Sexual Harassment

In cases of quid pro quo (this for that) were the victim is forced to have sex in exchange for job benefits a company or employer can be sued. Also a case of hostile work environment can be filed against an employer or an organization when an employer or co-employee makes unwelcomed sexual advances or physical conduct.



Conclusion

Lawyers can be very annoying but they are needed in your business so as to keep the business from lawsuits can could send it packing. As powerful as the employer is, so are the employees and the consumers, so in case of a legal war against your company, a legal practitioner is necessary.
